Accessory After the Fact

California Penal Code §32

California Penal Code §32 defines an “accessory after the fact.” After a felony has been committed, anyone who helps hide or conceal the original perpetrator or help them avoid an arrest and / or conviction, knowing that the original perpetrator committed the felony, is an accessory to the felony.

§32 Every person who, after a felony has been committed, harbors, conceals or aids a principal in such felony, with the intent that said principal may avoid or escape from arrest, trial, conviction or punishment, having knowledge that said principal has committed such felony or has been charged with such felony or convicted thereof, is an accessory to such felony.

For Example:

  • Helping your friend hide from the police with the requisite knowledge
  • Lying to the police about who committed a burglary
