Bribing an Executive Officer
California Penal Code §67
California Penal Code §67 makes it illegal to bribe an executive officer. An “executive officer” includes officials such as police officers. Almost any person bribed during the legal process is covered by some statute from the Penal Code: bribing judge or juror, PC §92, bribing a witness, PC §137, bribing an executive officer, PC §67.
§67 Every person who gives or offers any bribe to any executive officer in this state, with intent to influence him in respect to any act, decision, vote, opinion, or other proceeding as such officer, is punishable by imprisonment in the state prison for two, three or four years, and is disqualified from holding any office in this state.
For example:
- Offering of giving a police officer money or something of value to not give you a ticket.
- Paying or offering to pay a prosecutor money to dismiss the case
California Penal Code §67 is a felony.
